Financial Securities: To protect their revenue while your goods are at a subcontractor, Customs often requires a security deposit. For "critical goods," operators must provide a Bank Guarantee calculated on a percentage of the total customs duty and sales tax liability for a one-month operating cycle
The 90-Day Danger Zone: Penalties for Late Subcontractor Returns
A fundamental requirement of sending goods out for secondary processing is the 90-day rule: any material you send to a subcontractor must be processed and returned to your LMW within 90 calendar days.

Bills of Demand (BOD): Under Section 65AB of the Customs Act 1967, JKDM can issue a BOD demanding immediate payment of all evaded back-duties and sales taxes. Customs is empowered to retrospectively audit your records for up to six years.
Crushing Statutory Fines: Under Section 135(1), the punishment for unauthorized removal of uncustomed goods is incredibly steep. A first offense carries a minimum fine of 10 times the customs duty amount or RM50,000 (whichever is greater). The maximum penalty can reach 20 times the duty value or RM500,000, alongside a potential 5-year prison sentence.
